SuperCheapHouses.com Membership Terms and Conditions

All properties offered at Super Cheap Houses website shall be offered subject to the Sellers' approval of the price and final terms and conditions.  The Properties shall be offered through an internet bidding process with a specified opening and closing date.  All USERS MUST AGREE TO THE SITE RULES OF USE BEFORE BIDDING.

 Site Usage

All Sellers and Buyer’s must Registration to use this site.  Registration is currently free. Prospective buyers/bidders may view general information about each property just by clicking the links to the Home Page.  

Property Bidding

If you want to bid on a property, you must be registered to do so. Registration will require that you place a credit card on file.  No fee will be charged to buyers unless they default as the highest bidder.  You do not need to be registered in order to view bids for a property. All bids are open and displayed for public viewing unless otherwise noted.

You may “Watch” a Bid for future bidding by clicking on the Watch a bid feature.

Shill bidding, the practice of artificially inflating bid prices on your own or a partner's auction, will result in termination of your account.

Terms of Use

Each site user shall act with honesty and integrity while on the site, otherwise user privileges shall be revoked. Each bidder shall review and adhere to the Terms of Sale for each individual property listed on the site. Bargain Home Zone may suspend your account, and seek legal remedies, if it at anytime suspects that either as a buyer or seller, you have committed or engaged in fraud or fraudulent activities relating to transactions on the site. Any bidder making fraudulent bids on this site, or defaulting on properties won could be banned from the site indefinitely.

User Eligibility

Super Cheap Houses services are available only to individuals who can form legally binding contracts under applicable law.  Super Cheap Houses (SCH) services are not available to minors or to previously suspended SCH users.  If you register as a business entity, by placing a bid you represent that you have the authority to bind the entity to this Agreement and other real estate related agreements.

Email Notifications, Site Registration & Bidding Requirements

There are up to three levels of registration on Super Cheap Houses websites:  1)  Property Notifications:  To register to only receive "email notifications" about properties in your specified areas of interest, you must fill out a simple email registration form by clicking the Email Notifications link,  2) Member RegistrationMember Registration is not required to place a property for sale on the site and it is required to bid on all properties.   3)  Bidder RegistrationBidding on this site is a very simple yet sophisticated process.  If you intend to bid on a property,  registration is required.  In some cases, you will need to follow the additional Specific Bid Instructions to bid on that property.   In addition, it is advised that you already have pre-approval for financing.  You can get financing at www.HardMoneyExpert.com for most properties. 

Bidder information and password information is confidential and may not be shared or transferred to another party.  If you intend to bid on a property, it is highly recommended that you register at least 48 hours prior to the close of the bidding, just as a precaution against any potential registration problems.

Fees & Services

Currently Registration for Super Cheap Houses Sellers and Buyer’s is free. 

Property Description Rules

Seller needs to provide adequate information about the property for Buyer to make a decision to Buy..  Each property listing must contain a complete address plus a description about numbers of bedrooms, bathrooms, age and square footage.  Seller needs to also provide information about how the Bidder/Buyer can get in to see the property – (ie Lock Box Code)

Seller may announce that the property can be view during specific time frames during an OPEN HOUSE.  If so, the dates and times for the Open House need to disclosed on www.SuperCheapHouses.com

It is STRICTLY PROHIBITED for Seller to post their contact name, phone number, fax number, company information or URL links in this section. Any violations of this policy will result in Super Cheap Houses’ removal of all of such Customer’s active listings on the Service until all such content has been appropriately rectified.

Photographs

Sellers are required to post at least one picture of the actual property for sale.  An additional five (5) photos may be added at no additional charge.

Discrepancies in Advertisements

 If there are any discrepancies between the terms and conditions outlined on this site and the terms outlined in the Purchase Agreement, the terms in the Purchase Agreement shall prevail, so read the Purchase Agreement carefully.  All dates and times listed on this site supercede any advertisements or printed statements.

Negotiations & Post Event Activities

All properties will be sold to the highest bidder unless a “Buy It Now” bid is submitted by a Buyer.  In the case of a “Fixed Price” sale, the property will be sold on a first come, first served basis.

Final Approval by Seller

Each Seller on this site reserves the right to have final approval and acceptance of any an all Purchase Agreements submitted by any broker or bidder, regardless of information provided by this site or any Seller or Bargain Home Zone employee or affiliate to the contrary.

Completion of Sale  - Purchase Contract and Earnest Money

Each Seller will be responsible for immediate follow up with the successful bidder/buyer of their properties.  The Seller will be sent an email with contact information for the successful buyer.  Each Seller is responsible for providing their own Purchase and Sale Contract to the successful Bidder/Buyer within 24 hours of the conclusion of the auction.  Each Bidder/Buyer is responsible for completing the Purchase and Sale Contract then faxing it back to the Seller within 24 hours of receipt.  The Bidder/Buyer is also responsible for getting all earnest money to the title company or attorney specified by the Seller within 24 hours of the conclusion of the sale.

 Online Transaction Venue

Super Cheap Houses provides an online real estate transaction venue that allows for the bidding and transfer of properties via a public auction forum.  Super Cheap Houses does not hold itself out to be a real estate broker or agent, nor does it claim to act on behalf of buyers or sellers.  Super Cheap Houses does provide an efficient and sophisticated platform that allows sellers to advertise their properties to willing and able buyers. 

In the event a disruption of internet bidding service (such as a power outage) occurs at the end of an event, Super Cheap Houses reserves the right to extend that particular event for a twenty-four hour period in order to provide bidders a fair chance to compete for the purchase of a property.

By using www.SuperCheapHouses.com, all Sellers and Bidders have agreed to these terms and conditions.

Seller and Buyer Rules:

Each Seller who lists properties on this site shall be required to adhere to the following terms and conditions. If a Seller does not follow these terms and conditions, their rights to properties on the site shall be revoked

Seller: A "Seller" on this site shall be defined as a person or entity that is approved to list and sell properties on this site.

Bidder: A "Bidder" shall be defined as an approved registered bidder on Super Cheap Houses

Duration: The "Duration" is the timeframe in which a property is listed on the site to receive bids

Reverse Listing Fee / Internet Transaction Fee: NOT CHARGED AT THIS TIME. The "Internet Transaction Fee" / "Reverse Listing Fee" is a fee that is paid by the Seller to Super Cheap Houses at the conclusion of the auction. This fee is $150 per property sold.  This is not a bird dog fee - instead it is a "success only" transaction listing fee, unlike other auction sites.

1.)

Each Seller who lists properties on this site agrees to act with honesty and integrity.

2.)

Each Seller is responsible for maintaining complete and accurate information on the properties that it lists for bidding.

3.)

Each Seller agrees to deal honestly, fairly and courteously with all bidders provided by Super Cheap Houses. Rude behavior in dealings with bidders shall be grounds for Super Cheap Houses to revoke a Seller's right to list and sell properties on this site.

4.)

Each Seller agrees to place a “Bandit Sign” with www.SuperCheapHouses.com in the front yard of the property(ies) listed on Super Cheap Houses website during the time the property is being auctioned. See sign source for more details.

5.)

Each Seller agrees that it shall leave its property on the site for the duration of the event as selected by the Seller. If a property is removed from the site during the event time frame and sold to a Super Cheap Houses bidder, Seller agrees notify Bargain Home Zone and Seller will pay the $150 Internet Transaction Fee / “Reverse Listing Fee” to Super Cheap Houses.

6.)

Any property can be removed from the site at any time prior to or during the event time frame unless it has received active bids. If there are active bids on a property, the property can not be removed from the event without prior approval from Super Cheap Houses.

7.)

Each Seller is aware that a $150 Internet Transaction Fee / “Reverse Listing Fee” will be paid at the conclusion of the auction.   The fee will be charged to Seller’s credit card which was provided at registration.  If there is a problem with the credit card settlement, Seller agrees to provide alternate means of paying Super Cheap Houses.

8.)

Each Seller shall not attempt to contact bidders outside this Auction unless a bidder sends an email asking a question about the property.

9.)

Property descriptions are for the description of the property that is for sale or for auction only. The posting of contact name, phone number, fax number, company information or URL links is STRICTLY PROHIBITED in this section. Any violations of this policy will result in Super Cheap Houses removal of all of such Customer’s active listings on the Service until all such content has been appropriately rectified.

10.)

Each Seller agrees that it shall not influence the bidding for its properties and shall not tender any bids directly on its properties.

11.)

All listings entered on Super Cheap Houses may be subject to review by Super Cheap Houses company personnel. Super Cheap Houses reserves the right, but not the obligation, to review any listing entered by Customer on Super Cheap Houses  If, in the sole discretion of Super Cheap Houses, there is a violation of the listing policy or guidelines, your listing could be removed or subdued until the listing violation is corrected. 

If there is a listing violation, the customer will be notified by email and given 24 hours to correct the problem.  If the problem is not corrected, the listing will be permanently removed from the web site.

12.)

The management of Super Cheap Houses reserves the right to revoke any or all of an existing Seller's privileges for any reason with or without cause.

13.)

The management of Super Cheap Houses reserves the right to deny any person, corporation or business entity "Approved Seller Status" for any reason in its sole and absolute discretion.

14.)

Each Seller agrees that it has the right to list a property on this site either as the owner or as agent for the owner.

15.)

Each Seller understands that Super Cheap Houses is a transaction vehicle only and there is a fiduciary relationship but no agency relationship with the Seller.

16.)

Each Seller and Buyer agrees to release and hold harmless Super Cheap Houses from any claims that may arise from the Sellers actions related to any transaction on the site.

17.)

Super Cheap Houses has no warranties as to its abilities to obtain a bid or an acceptable price for a property. All events are public in nature.

By using www.SuperCheapHouses.com, each Seller and Bidder/Buyer agrees to these terms and conditions.
